In a civil rights action, challenging police officer defendant’s arrest of plaintiff following her refusal to allow Child Protective Services to interview her child as part of a child neglect investigation, the district court’s grant of summary judgment to defendant on qualified immunity grounds is vacated where the current record doesn’t establish that defendant had grounds to arrest plaintiff.
