Property division, or equitable distribution, is often one of the more complex matters in a matrimonial dissolution. A “50-50” split of the assets and liabilities is not what is meant by the term equitable, rather it means that the court will look to divide the property between the parties in a fair manner based on numerous factors. One consideration the court must determine is whether the property in question is marital or non-marital. This is an essential determination because depending on the determination the court will either use it in the distribution or not.
