Paternity
When a child is born to an unmarried couple living together, or a single woman in a dating relationship who later claims a child resulted from that relationship, questions of support routinely arise. Paternity actions are filed in order to assist a parent in acknowledging and protecting important visitation (time sharing), custody (time sharing schedule and parenting plans), and support rights (child support) or for a child who may benefit through newly acquired legal rights (social security benefits, veteran’s benefits and inheritance rights).

In some cases, the partner claims or acknowledges that he is the parent, while in other instances, testing is necessary to rule out or determine paternity. Who can file a paternity suit?
A paternity suit can be filed by any woman who is pregnant or has a child, any man who has reason to believe that he is the father of a child, or any child may bring proceedings to determine paternity when paternity has not been established.

Once paternity is established, the court may determine custody (time sharing schedule and parenting plans), payment of child support (present and retroactive), payment of attorney fees, and costs of bringing the action.
